Terms of Service

These Terms of Service ("Terms") govern your use of the RightMatch job matching application ("RightMatch" or the "App") provided by RightMatch Sdn Bhd ("Company," "we," "our," or "us"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, you may not use the App.

1. Acceptance of Terms

By accessing or using the RightMatch App, you represent and warrant that you have read, understood, and agree to be bound by these Terms. These Terms constitute a legally binding agreement between you and RightMatch Sdn Bhd. If you are accessing or using the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Use of the App

1. Eligibility: You must be at least 18 years old to use the RightMatch App. By using the App, you represent and warrant that you are at least 18 years old.
2. RightMatch Account: In order to access certain features of the App, you may need to create a RightMatch account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated. You are responsible for maintaining the security and confidentiality of your account credentials.
3. Prohibited Activities: You agree not to engage in any of the following activities while using the RightMatch App:
   1. Violating any applicable laws, regulations, or these Terms.
   2. Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
   3. Uploading, transmitting, or distributing any computer viruses, malware, or other harmful software.
   4. Interfering with or disrupting the integrity or performance of the App or its related systems.
   5. Collecting or harvesting any personally identifiable information from the App without proper authorization.
   6. Engaging in any conduct that restricts or inhibits any other user from using or enjoying the App.

3. Intellectual Property

1. Ownership: The RightMatch App and all intellectual property rights associated with it are owned by RightMatch Sdn Bhd. You acknowledge and agree that the App and its content, including but not limited to text, graphics, logos, trademarks, images, and software, are protected by copyright, trademark, and other laws.
2. License: RightMatch grants you a limited, non-exclusive, non-transferable, revocable license to access and use the App for its intended purpose. You may not modify, distribute, reproduce, or create derivative works based on the App or its content without prior written consent from RightMatch.

4. Disclaimer of Warranties

1. The RightMatch App is provided on an "as is" and "as available" basis without any warranties of any kind, whether express, implied, or statutory. RightMatch disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
2. RightMatch does not guarantee the accuracy, reliability, availability, or completeness of any information provided through the App. You acknowledge that your use of the App is at your sole risk and discretion.

5. Limitation of Liability

1. To the maximum extent permitted by applicable law, RightMatch and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, resulting from your use or inability to use the App.
2. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you. In such cases, the liability of RightMatch and its affiliates, officers, directors, employees, agents, and licensors shall be limited to the fullest extent permitted by applicable law.

6. Indemnification

You agree to indemnify, defend, and hold harmless RightMatch Sdn Bhd and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the RightMatch App, your violation of these Terms, or your violation of any rights of another party.

7. Modifications to the Terms

RightMatch reserves the right to modify these Terms at any time, without prior notice. Any changes to the Terms will be effective immediately upon posting on the RightMatch website or within the App. Your continued use of the App after the posting of any modified Terms constitutes your acceptance of the modified Terms.

8. Termination

RightMatch may, in its sole discretion, terminate or suspend your access to the App at any time and without prior notice for any reason, including but not limited to your violation of these Terms. Upon termination, your right to use the App will immediately cease, and you must cease all use of the App.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

10. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

11. Entire Agreement

These Terms constitute the entire agreement between you and RightMatch Sdn Bhd regarding the use of the RightMatch App, superseding any prior agreements or understandings, whether oral or written.
